Guidance on undertaking the value test

On 18 September 2023, DWP laid regulations that will amend the PPF compensation provisions in the Pensions Act 2004 for members of schemes that enter a PPF assessment period on or after 1 January 2024. The regulations insert a value test that will apply to most members and ensure that the value of their PPF compensation is at least 50% of the value of their scheme benefits. To date, the PPF has been applying this value test in order to give effect to the CJEU's judgment in Hampshire v PPF. These regulations will retain the effect of the Hampshire judgment and incorporate it into the Pensions Act 2004. This guidance sets out how the value test, and any resulting adjustment to a member's PPF compensation entitlement, required under these new provisions in the Pensions Act 2004 should be calculated.
